EFCC counsel, S.A. Obafemi announced that there was no clear directive from the commission on the steps to take, and asked for an adjournment.
The main prosecutor, Rotimi Jacobs (SAN), was also absent in court as a result of the situation.
But the defence counsel, Ola Olanipekun and Olalekan Ojo had opposed the request for adjournment, and accused the EFCC of persecuting Mr Fayose.
They also withdrew their objection to the reassignment of the case, since the initial judge, Justice Mojisola Olatoregun would be retiring in November.
