EXTRACTS FROM THE JUDGEMENT IN SUIT NO:AK61ç/2020 BETWEEN COMMISSIONER OF POLICE AND ADEWUMI MATTHEW, OJOPAHUN TOPE, STELLA AKINBOBOLA, ON WEDNESDAY 25TH MAY 2022 AT AKURE HIGH COURT

                  IN SUMMARY
                     CHARGES

1.CONSPIRACY: She Conspired to commit felony to wit: forgery and altering a Warrant of Possession after same had been signed by his lordship Hon Justice Bode Adegbehingbe

  1. FORGERY: She Forged Warrant of Possession after duly signed by his lordship Hon Justice Bode Adegbehingbe.

3.ALTERING OF FALSE DOCUMENT: She Fraudulently alter false Warrant of Possession knowing it to be false by giving it to Commissioner of Police Ondo State for execution of the judgement in suit No. HOD/57/2018 via a letter dated June 2018.

  1. FALSIFICATION OF DOCUMENT: Making false entry which materially changed the Warrant of Possession
  2. FORCIBLE ENTRY: In a manner likely to cause breach of peace or apprehension of breach of peace
    Forcibly entered a parcel of land in peaceful Possession of Alasin family, ìgbà family, Adegboremi family, Igbo-Ore and Atoyo family land at Asin camp
  3. MALICIOUS DAMAGE: She and others at large maliciously cut down and destroyed economic trees worth N100,000,000:00 all properties of Alasin, Ìgbà, Adegboremi, Igbo-Ore and Atoyo families at Asin camp
  4. REMOVING/DESTROYING BOUNDARY MARKS WITH INTENTS TO DEFRAUD: She unlawfully and maliciously removed and destroyed survey pillars and other boundary marks on Alasin, Ìgbà, Adegboremi, Igbo-Ore and Atoyo families land at Asin camp. JUDGEMENT

THAT TOPE OJOPAHUN WAS NOT FOUND GUILTY IN ANY OF THE COUNTS THEREBY DISCHARGED AND ACQUITTED.

  1. THAT STELLA AKINBOBOLA WAS GUILTY OF COUNT CHARGE (NO.1) AND THEREBY SENTENCED TO SEVEN YEARS IMPRISONMENT WITH THE OPTION OF FINE TO PAY TWO HUNDRED AND FIFTY THOUSAND NAIRA (N250,000) ONLY.
  2. THAT STELLA AKINBOBOLA WAS ALSO GUILTY OF COUNT CHARGE (NO.5) FORCIBLE ENTRY TO ALASIN, ÌGBÀ ADEGBOROMI, IGBO-ORE AND ATOYO FAMILIES LAND THEREBY SENTENCED TO ONE YEAR IMPRISONMENT TO RUN CONCURRENTLY.

WHILE ADEWUMI MATTHEW WAS GUILTY OF COUNT CHARGE 1,2 3 AND 4 THEREBY SENTENCED TO SEVEN YEARS IMPRISONMENT TO RUN CONCURRENTLY WITH THE OPTION OF FINE TO PAY ONE HUNDRED THOUSAND NAIRA (N100,000:00) ONLY ON EACH COUNT CHARGE.

ARE NOW THE SUBSTANTIVE AND RIGHTFUL OWNERS OF THE LAND

WHILE STELLA AKINBOBOLA CAN NO LONGER LAY CLAIM TO ANY LAND IN THE FAMILIES LAND MENTIONED ABOVE WHEREAS SHE HAD BEEN ADJUDGED A TRESSPASSER, AND NO APPELLATE COURT HAS SET ASIDE THE TWO JUDGEMENT AGAINST STELLA AKINBOBOLA ON THE LANDS.

  1. IT WAS ALSO ESTABLISHED THAT THE WARRANT OF POSSESSION BEING CARRIED ABOUT BY STELLA AKINBOBOLA WAS FRAUDULENTLY OBTAINED AND THEREBY SET ASIDE AS WELL.
