The court of appeal sitting in Akure, the Ondo state capital on Wednesday has dismissed the cross-appeal sought by Governor Oluwarotimi Akeredolu.
Akeredolu had approached the appellate court to challenge the ruling by the election tribunal which affirmed the court’s constitutional right to hear the prayer of the PDP and its candidate, Eyitayo Jegede.
Akeredolu’s ground was that, the case pursued by Jegede and the PDP is a pre-election matter, and shouldn’t be entertained at the tribunal.
Hon. Justice Theresa Orji-Abadua while ruling on the matter, upheld the judgment of the election tribunal that the court can entertain Mr Jegede’s prayer and that of the PDP.
The ruling by Justice Orji-Abadua was supported by the other four judges on the panel.
The court of appeal had earlier ruled that the main prayer sought by Jegede and PDP, lacks merit.
“The appeal is partially dismissed and partially allowed,” the court ruled.
The implication of the judgment is that Governor Oluwarotimi Akeredolu remains the duly elected candidate in the October 10, 2020 election in the state.
